These Terms of Service ("Terms") govern your access to and use of https://www.trve.com and any services provided by Trve Ventures LLC, doing business as Trve Voice AI ("Trve," "Company," "we," "us," or "our").

By accessing our website, contacting us, submitting a form, purchasing services, using our services, or allowing calls to be handled through our services, you agree to these Terms. If you do not agree to these Terms, do not use our website or services.

These Terms are intended to apply to general website use and services provided by Trve. Certain clients may also be required to sign a separate service agreement, order form, statement of work, or similar agreement. If a signed written agreement conflicts with these Terms, the signed written agreement will control for the conflicting terms.

1. Description of Services

Trve provides AI phone answering, AI receptionist, virtual receptionist, call handling, appointment scheduling, lead capture, call summaries, call transcripts, call transfers, SMS/email notifications, call workflow setup, and related business communication services.

Our services may use artificial intelligence, automation, telecommunications tools, call recording tools, transcription tools, white-label platforms, third-party software, and related service providers.

2. Business Use

Our website and services are intended for business use. By using our services, you represent that you are at least 18 years old and have authority to act on behalf of the business or entity you represent.

You may not use our services for unlawful, abusive, deceptive, harmful, or unauthorized purposes.

3. Client Responsibilities

Clients are responsible for providing accurate, complete, and current business information needed to configure and operate the services. This may include business name, services, pricing, policies, business hours, appointment rules, call transfer instructions, emergency instructions, frequently asked questions, customer service procedures, lead qualification criteria, and other business-specific details.

Clients are responsible for reviewing and approving their AI receptionist setup, call flow, scripts, prompts, FAQs, instructions, and related configurations before launch.

Clients are responsible for promptly notifying Trve of any changes to their business information, pricing, hours, policies, appointment rules, staff, phone numbers, call transfer instructions, or other information that may affect the services.

Trve is not responsible for errors, missed calls, incorrect responses, inaccurate appointment scheduling, customer misunderstandings, or other issues caused by inaccurate, incomplete, outdated, or unclear information provided by the client.

4. AI and Service Limitations

Client understands and agrees that the services may use artificial intelligence, automation, speech recognition, transcription, third-party platforms, phone carriers, internet services, and related technologies.

AI-generated responses, call handling, transcripts, call summaries, lead information, appointment information, and automated actions may contain errors, omissions, delays, misunderstandings, or inaccuracies.

Trve does not guarantee that the services will be uninterrupted, error-free, accurate, complete, or suitable for every caller, situation, industry, or business need.

Client is responsible for independently reviewing call summaries, transcripts, appointment details, lead information, and any other information generated through the services before relying on it.

5. No Emergency Use

The services are not intended for emergency communications or emergency dispatch.

Clients must not represent that the services are suitable for emergency calls, urgent medical situations, life-safety situations, crisis response, emergency dispatch, or other time-sensitive situations where failure, delay, or error could result in harm.

Clients are responsible for instructing callers to contact emergency services directly when appropriate.

6. No Professional Advice

The services are not designed to provide legal, medical, financial, tax, insurance, mental health, emergency, or other professional advice.

Clients must not configure or use the services in a way that causes the AI receptionist to provide regulated professional advice unless the client has obtained all required legal approvals, professional oversight, disclosures, licenses, and compliance measures.

7. Call Recording, Transcription, AI Processing, and Consent

Our services may involve call recording, call monitoring, call transcription, AI processing, call summaries, SMS/email notifications, appointment scheduling, lead capture, and call transfer features.

Laws regarding call recording, monitoring, transcription, consent, privacy, SMS, marketing communications, and AI disclosure vary by state, country, industry, and situation. Some jurisdictions require notice or consent from one or all parties before recording, monitoring, or transcribing a call.

Client is solely responsible for determining and providing all legally required notices and obtaining all legally required consents from callers, customers, employees, patients, leads, or other individuals before using call recording, transcription, AI receptionist, SMS, email, appointment scheduling, call transfer, or related features.

Trve may provide suggested disclosure language, but Client remains solely responsible for legal compliance.

Trve is not responsible for Client's failure to provide required notices, obtain required consents, or comply with applicable laws.

8. Privacy and Data

Our collection, use, disclosure, and handling of personal information is described in our Privacy Policy.

By using our website or services, you acknowledge and agree that information may be collected, processed, stored, transmitted, and shared as described in our Privacy Policy.

Clients are responsible for ensuring that their use of the services complies with all privacy, data protection, call recording, consumer protection, marketing, employment, healthcare, financial, industry-specific, and other laws that apply to their business and callers.

9. Use of White-Label Platform and Third-Party Providers

Trve uses third-party technology platforms and service providers, including Autocalls.ai, to help provide AI receptionist, AI phone answering, call automation, call handling, transcription, call summaries, lead capture, and related services.

Trve may also use telecommunications providers, phone number providers, AI providers, hosting providers, transcription providers, SMS/email providers, CRM tools, calendar tools, payment processors, e-signature providers, analytics tools, and other vendors.

Client understands and agrees that call-related information, caller data, transcripts, recordings, business instructions, prompts, call summaries, appointment details, lead details, and related service data may be processed by third-party platforms and providers as necessary to provide the services.

Trve is not responsible for outages, errors, delays, downtime, data loss, security incidents, feature changes, pricing changes, discontinuation, inaccurate outputs, or failures caused by third-party platforms, providers, phone carriers, integrations, internet services, client systems, or other systems outside Trve's reasonable control.

10. Payments, Subscriptions, and Billing

Fees, billing cycles, included services, usage limits, setup fees, monthly fees, and other payment terms may be described on our website, invoice, checkout page, order form, or signed agreement.

Unless otherwise stated in writing, subscription fees are billed in advance and automatically renew until canceled.

Client authorizes Trve and/or its payment processor to charge the payment method provided for all applicable fees, subscriptions, usage charges, taxes, and other amounts due.

Client is responsible for keeping payment information current and accurate.

If payment fails, is disputed, is reversed, or is not received when due, Trve may suspend, restrict, or terminate services.

11. Cancellation

Unless otherwise stated in a signed agreement, clients may request cancellation by emailing:

Cancellation requests must be submitted before the next billing date to avoid renewal charges.

If a subscription renews before cancellation is received and processed, the renewal charge may be non-refundable unless otherwise required by law or agreed in writing.

Trve may provide additional cancellation methods where required by applicable law.

12. Refund Policy

Unless otherwise stated in writing, all payments are non-refundable.

This includes setup fees, monthly subscription fees, usage fees, prepaid fees, and other charges.

Trve may, in its sole discretion, issue credits or refunds on a case-by-case basis. Issuing a refund or credit in one instance does not require Trve to issue a refund or credit in the future.

13. Service Availability

Trve does not guarantee that the services will be available at all times or operate without interruption.

The services may be affected by maintenance, updates, internet outages, phone carrier issues, telecommunications failures, third-party platform outages, integration errors, payment issues, client system failures, incorrect configuration, force majeure events, or other causes.

Trve is not responsible for missed calls, failed call transfers, delayed responses, unavailable phone numbers, failed SMS/email notifications, failed appointment scheduling, transcription errors, AI errors, carrier issues, third-party outages, or other service interruptions.

14. Client Systems and Integrations

If the services connect to or interact with Client's phone system, call forwarding, calendar, CRM, email, SMS, website, forms, or other systems, Client is responsible for ensuring those systems are properly configured, available, secure, and compatible.

Trve is not responsible for issues caused by Client's systems, credentials, forwarding rules, phone settings, calendar settings, CRM settings, email settings, account permissions, expired access, revoked access, or third-party configuration changes.

15. Acceptable Use

You may not use the website or services to:

Trve may suspend or terminate access to the services if we believe a client or user has violated these Terms or created risk for Trve, our providers, callers, customers, or others.

16. Regulated and Sensitive Industries

Clients operating in regulated or sensitive industries are solely responsible for determining whether the services are appropriate for their business and for complying with all applicable laws, rules, regulations, licensing obligations, privacy requirements, disclosure obligations, and industry standards.

This may include, without limitation, healthcare, legal, financial services, insurance, employment, debt collection, real estate, automotive, childcare, education, government-related services, and other regulated industries.

Trve does not represent that the services are compliant with any specific industry law or regulatory framework unless expressly agreed in a signed written agreement.

17. Intellectual Property

The website, branding, logos, designs, text, graphics, software, workflows, service structure, scripts, prompts, configurations, content, and other materials provided by Trve are owned by Trve or its licensors and are protected by intellectual property laws.

Clients may not copy, reproduce, distribute, modify, reverse engineer, resell, sublicense, or create derivative works from Trve's materials except as expressly permitted in writing.

Client retains ownership of Client's own business information provided to Trve. Client grants Trve a limited right to use that information as necessary to provide, operate, improve, support, and secure the services.

18. Feedback

If you provide suggestions, ideas, feedback, improvements, or recommendations to Trve, you grant Trve the right to use them without restriction or compensation.

19. Confidentiality

During the course of providing services, Trve and Client may exchange confidential or business-sensitive information.

Each party agrees to use reasonable efforts to protect confidential information from unauthorized disclosure. Confidential information does not include information that is publicly available, independently developed, already known, or lawfully received from another source without confidentiality obligations.

Trve may disclose confidential information to its employees, contractors, service providers, advisors, and vendors as necessary to provide services or operate its business, provided such parties are subject to confidentiality or similar obligations.

20. Disclaimers

To the maximum extent permitted by law, the website and services are provided on an "as is" and "as available" basis.

Trve disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

Trve does not warrant that the services will meet Client's requirements, produce any particular result, increase revenue, capture every lead, answer every call, schedule every appointment correctly, or operate without errors or interruptions.

21. Limitation of Liability

To the maximum extent permitted by law, Trve Ventures LLC, including its owners, officers, employees, contractors, vendors, affiliates, licensors, and service providers, shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost business opportunities, lost data, lost goodwill, missed calls, missed appointments, incorrect call handling, caller misunderstandings, service interruptions, AI errors, transcription errors, call transfer failures, SMS/email failures, appointment scheduling errors, data loss, or business losses arising out of or related to the website or services.

To the maximum extent permitted by law, Trve's total liability for any claim arising out of or related to the website or services shall not exceed the amount paid by Client to Trve for the services during the one (1) month immediately preceding the event giving rise to the claim.

The limitations in this section apply regardless of the legal theory, whether based in contract, tort, negligence, strict liability, warranty, statute, or otherwise, even if Trve has been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be limited under applicable law.

22. Data Security Disclaimer

Trve uses commercially reasonable administrative, technical, and organizational safeguards designed to protect information processed through the services.

However, no system, platform, network, transmission method, phone system, cloud service, AI platform, third-party platform, or electronic storage method is completely secure.

Client acknowledges that Trve cannot guarantee absolute security and that unauthorized access, cyberattacks, data loss, service interruptions, or security incidents may occur.

To the maximum extent permitted by law, Trve is not responsible for unauthorized access, disclosure, loss, theft, misuse, alteration, or destruction of information caused by circumstances outside Trve's reasonable control, including third-party platform failures, cyberattacks, telecommunications issues, internet outages, user error, client misuse, unauthorized access to client-controlled systems, or failures of systems not controlled by Trve.

23. Indemnification

Client agrees to defend, indemnify, and hold harmless Trve Ventures LLC, including its owners, officers, employees, contractors, affiliates, vendors, licensors, and service providers, from and against any claims, damages, losses, liabilities, penalties, fines, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

Trve may suspend, restrict, or terminate access to the website or services at any time if:

Upon termination, Client remains responsible for all unpaid fees and obligations incurred before termination.

25. Changes to Services

Trve may modify, update, suspend, replace, or discontinue any part of the website or services at any time.

Trve may change features, providers, platforms, pricing, service structure, included minutes, overage rates, support options, and service availability from time to time.

Material changes affecting active paid clients may be communicated by email, website notice, invoice, or other reasonable method.

26. Changes to These Terms

Trve may update these Terms from time to time. When changes are made, we will update the "Last Updated" date above.

The updated Terms will be effective when posted unless otherwise stated.

Your continued use of the website or services after updated Terms are posted means you accept the updated Terms.

27. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms, the website, or the services shall be brought in the state or federal courts located in California, unless otherwise required by applicable law or agreed in writing.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

29. No Waiver

Trve's failure to enforce any provision of these Terms does not waive Trve's right to enforce that provision or any other provision in the future.

30. Assignment

Client may not assign or transfer any rights or obligations under these Terms without Trve's prior written consent.

Trve may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, reorganization, financing, change of control, or by operation of law.
